Dear Carillon Resident:

As many of you are aware, the Association filed a lawsuit for declaratory and injunctive relief in February 2009 to challenge the County’s approval of the 4-story, 600-bed student housing complex proposed to be located at the entrance of the Carillon community.  In Count III of this lawsuit, the Association alleges that  the proposed student housing project violates the UCF Campus Master Plan, which mandates that "University owned housing shall be built on campus grounds."  In July and October 2010, the Developers and the County filed separate motions for summary judgment seeking to have the circuit court throw out Count III, claiming UCF does not own the student housing project.

On February 3, 2011, the circuit court held a hearing on the Developers' and the County's motions.  At the conclusion of the hearing, the circuit court denied the Developers' and the County's motions, thereby ruling in the Association's favor and refusing to throw out Count III.  This is the second time the circuit court has denied the County's attempts to dispose of Count III.

For complete and accurate information regarding the Association’s legal challenges to the student housing project, we encourage you to visit the Association’s website for ongoing status updates and copies of the court filings.
